Brooke B. Murphy

Brooke Bradley Murphy focuses her practice on civil litigation, including medical malpractice defense, commercial and insurance defense, class action litigation, and products liability litigation. She has served as lead counsel in matters ranging from medical malpractice claims to commercial contract disputes, and has tried cases in both state and federal courts. Clients rely on her thoughtful, strategic approach and her judgment on the hardest calls a case presents.

Brooke is a proud member of the American Board of Trial Advocates (ABOTA), the International Society of Barristers (ISOB), and the International Association of Defense Counsel (IADC). She is a Senior Fellow of Litigation Counsel of America, a Fellow of the American Bar Foundation, and a member of the Trial Law Institute, the Diversity Law Institute, the Defense Research Institute, the Montana Defense Trial Lawyers Association, and her state and local bar associations. She holds an AV Preeminent® rating from Martindale-Hubbell, its highest rating for legal ability and professional ethics.

Brooke has been selected by her peers for inclusion in The Best Lawyers in America in Products Liability Litigation and Commercial Litigation every year since 2009, and has been named Best Lawyers "Lawyer of the Year" for Products Liability Litigation - Defendants on three occasions. She has been named a Mountain States Super Lawyer or Rising Star every year since 2008. She has also been recognized among the "Top 50 Women" lawyers in the Mountain States every year since 2018.

Brooke earned her Juris Doctor from the University of Montana School of Law in 2000 and is admitted to practice before all Montana state courts, the U.S. District Court for the District of Montana, and the U.S. Court of Appeals for the Ninth Circuit. Following law school, she joined an established litigation defense firm in Billings and became a shareholder in January 2006. She co-founded MurphyMyers PLLC in Billings in 2018, and in 2026 founded Murphy Sather PLLC with Ben Sather, continuing her focus on personal, practical, and cost-effective representation.

Brooke has a deep sense of community. She serves on the Board of Visitors for the Alexander Blewett III School of Law at the University of Montana and on the Board of the Taco Dowler Youth Foundation, an organization committed to creating opportunities for Montana children through education, athletics, and community engagement. She is a past president of the Alberta Bair Theater Board of Advisors, where she served for many years. Brooke is married to Gavin Murphy, and together they have three incredible children. When not in the office, she enjoys spending time with her family and teaching and playing Mahjong.

Ben Sather

Ben Sather has been practicing law in Billings and throughout Montana, since 2007, representing businesses and individuals in a diverse mix of civil litigation including: insurance, business, construction, and real property litigation as well as labor and employment law. Ben obtained his Juris Doctorate from the University of Montana School of Law and is admitted to practice before all Montana state courts, the U.S. District Court for the District of Montana, and the U.S. Court of Appeals for the Ninth Circuit.

Ben worked for the law firm of Christensen Fulton & Filz, PLLC, from 2007 to 2013. From 2013 to 2023, Ben was the owner of Sather Law, PLLC. While running Sather Law, PLLC, Ben represented both individuals in insurance claims along with insurance companies and their insureds. In 2023, Ben joined MurphyMyers PLLC to focus on all stages of civil litigation, including commercial and insurance defense.

Ben was born and raised in Havre, Montana. After graduating from Havre High, Ben attended the University of Montana, graduating with a degree in business administration. Ben stayed in Missoula, attending law school at the University of Montana.

While in law school, Ben served as a legal clerk for the United States Senate Finance Committee. He also worked as an intern for the Missoula County Attorney as a prosecuting attorney for two years. While there, Ben prosecuted a wide variety of criminal charges in Missoula County, trying many cases to juries and judges. During Ben's third year of law school, Ben was selected as a clinical intern for United States Federal Magistrate Leif Erickson.

Upon completion of his legal studies, Ben served as a law clerk for the Montana Supreme Court, working with Justices James Nelson, Jim Rice, and W. William Leaphart. Ben worked closely with the justices of the Court and other law clerks, developing meticulous legal research and writing skills while learning the intricacies of appellate practice in Montana.

Ben maintains close ties to his hometown of Havre and the Montana Hi-Line. Ben is a current board member of the Havre Public Schools Education Foundation, which focuses on educational and academic opportunities for the students of Havre Public Schools. Ben is a former member of the Board of Trustees for the State Bar of Montana. He was elected to serve in this position by the attorneys of Yellowstone County and the surrounding areas. Ben is a past President of the Yellowstone Area Bar Association and Director of the Board of Directors for the Yellowstone Area Bar Association.

Ben has two daughters, Evey and Nora. Together, they enjoy traveling, music and spending time with their dog Tommy.

Nathan Smith

Associate Attorney

Nathan Smith practices primarily civil litigation in Billings and throughout Montana. He defends individuals, physicians, contractors, and businesses in a diverse mix of matters including medical malpractice defense, insurance bad faith, construction defect, general liability, and complex commercial litigation.

Nathan has handled every phase of civil and commercial litigation, from early case assessment through discovery, motion practice, and resolution. He approaches each matter with disciplined preparation and a clear plan, keeping clients informed on strategy, exposure, and cost at every stage.

Nathan grew up in Billings and graduated from Billings West High School. Before college, he spent two years in Santiago, Chile, in full-time volunteer service, where he became fluent in Spanish. He went on to the University of Utah, earning a Bachelor of Arts in Spanish and making the Dean's List every semester.

He received his Juris Doctor from the Benjamin N. Cardozo School of Law at Yeshiva University in 2022, where he was selected as a Berg Fellow. During law school, Nathan interned with Catholic Charities of the Archdiocese of New York, representing unaccompanied minors in asylum, withholding of removal, and Special Immigrant Juvenile Status matters. That work taught him how much careful preparation and credibility matter when the stakes are high and the facts are contested. He also interned with two prominent New York litigation and transactional firms, gaining exposure to large-scale commercial disputes and deal work. At Cardozo, he served on the Outreach Committee of the Cardozo Business Society and was a member of the Cardozo Dispute Resolution Society and the Latin American Legal Society.

Before joining MurphySather PLLC, Nathan practiced across Montana, handling civil and commercial litigation for clients in a range of industries for a large law firm in Billings. That statewide experience gave him a practical feel for the courts and communities where his cases are heard.

Nathan is a member of the State Bar of Montana and is admitted to practice before all Montana state courts and the United States District Court for the District of Montana.

Outside the office, Nathan spends his time with his family and his dog, running, traveling, and getting outdoors as often as Montana allows.
